An obligation of confidentiality might be an express term of the arbitration agreement, or a term implied by law, or it might arise in equity, and ‘privacy’ can also be protected in tort. The Law Commission has concluded that the AA 1996 is compatible with the use of modern technology. It must be subject to exceptions.
